Tamil Nadu ordinance on banning online gambling expires for want of Governor’s assent

The Ordinance banning online gambling in Tamil Nadu expired on Sunday night. The Governor did not give assent to the Bill passed by the Assembly last month. This has sparked a new conflict between the state government and the Governor. A migrant worker, Pandhana Maji, 22, committed suicide at Tenkasi on Monday. Since 2020, at least 30 suicides in the Tamil state have been linked to losses in online gaming. The government established a committee to investigate the issue. In June 2022, the committee recommended banning the games. It was delayed by six weeks.

Tamil Nadu’s Ordinance Banning Online Gambling Lapses

The Tamil Nadu Assembly passed an ordinance prohibiting online gambling and regulating online gaming earlier this year. Governor R N Ravi gave his assent to the same on 1st October. The State Assembly tabled the Tamil Tamil Prohibition of Online Gaming and Regulation of online Games Bill to ban online betting and regulate online games. However, the bill is pending approval from the governor and the ordinance lapsed on the intervening night of 27th November and 28th of November.

Online gambling in Tamil Nadu will invite two years imprisonment and a fine not exceeding Rs 10,000. The Bill seeks to replace an ordinance banning cyberspace gambling. It covers games like rummy, poker and gambling involving wagering or betting in person or in cyber space. The statement of objects and reasons for the Bill says that gambling is addictive and there were some incidents of suicide. There was an earlier ordinance. Bill proposes amendments to the Tamil Tamil Gaming Act, 1930, The Chennai City Police Act and the Tamil Nadu District Police act. They are intended to ban online gambling and provide punishment which includes imprisonment, fine or both.
