The Province of Buenos Aires has the management and exploitation of all casinos and gaming halls. The competent authorities retain regulation and control competence over gaming and gambling. As of December 2016, the legal basis for the measures was Sections 116 and 117 of the Contravention and Misdemeanor Code and Section 301 bis of Argentine National Criminal Code.

The legal framework applicable to gambling and gaming in Argentina is mainly local. It follows the continental tradition and the value of case law is limited. The federal government issues the regulations. All government levels issue the tax regulations, with some limits for the provincial and municipal authorities.

The legal framework in Argentina is for bricks-and-mortar gambling. Some jurisdictions have expanded the legal system to include online gambling and gaming. Land-based gambling is regulated and authorised in all jurisdictions in the country. Remote gambling in general is restricted to certain provinces. Online gambling operators are subject to a licence. In Argentina, geoblocking is not available. There are no nationwide remote gambling offers. The only exception is the lottery ticket sale venues. Players can only cash in and out in lottery tickets and betting shops within the province or jurisdiction granting the online gaming licence, and they can't use geobexting.
