Brexit: Impact on gambling providers operating in Germany

Gambling providers who want to operate in Germany need a German gambling licence. Licences for private providers can be granted for the organisation and brokerage of sports betting and for commercial gambling brokerage.

Providers that previously only had a registered office in the UK must now establish aregistered office if they want to obtain a German gambling licence. The licence requirements have an EU connection. For example, gaming-related payment transactions must be processed via an account in Germany or at a credit institution domiciled in an European Union member state. A bank account with a bank in Malta would be sufficient.
According to EU law, a bank account in the UK or Malta no longer meets the requirements for gaming-related payment transactions. A bank guarantee must be provided by a credit institution with its registered office in an EU or EEA member state.
The new GlüStV 2021 is to come into force on 1 July 2021. It will open up new licensing possibilities for online casino games and for virtual slots.
